A Gweru prosecutor, Namatirai Chipere recently excused herself in an assault case involving MDC Chiwundura legislator, Livingstone Chimina after the latter pleaded with the courts that the former was a well known Zanu PF supporter and would likely be prejudiced in handling the matter.
Gweru provincial magistrate, Sangster Tawengwa consented to the recusal before postponing continuation of trial to June 29.
Chipere had threatened to sue Chimina for labelling her an interested party because of her political affiliation but Tawengwa said the issue could be discussed in chambers with Chimina’s lawyers.
Chimina and two other Gweru City Council employees are accused of allegedly assaulting Zanu PF youths.
Chimina and Kudzanai bus terminus supervisor Leticia Mteliso, are alleged to have assaulted three Zanu PF activists who stormed Kudzanayi long-distance bus terminus and illegally collected ranking fees from transport operators.
When trial commenced last year Chimina’s lawyers submitted that the complainants are the ones who should be charged for extortion.
When the incident occurred in January last year, mayor Josiah Makombe called a press conference and alleged that six suspected criminals had invaded Kudzanai rank illegally collecting levies from bus operators charging half the fees set by the local authority.
