Marryward Marara residing at No 2895/1 Mkoba 14 appeared before the Regional Magistrate Phathekile Msipa facing allegations of rape as defined by Section 65 of the (Criminal law Codification and Reform) Act Chapter 9:23.
He pleaded not guilty to the charges.
State counsel, Talent Tadenyika told the court that Marara who is known as Madzibaba Jeremiah of the Johane Masowe Wechishanu sect allegedly raped a client (name withheld) after being referred to him by her aunt as she needed prayers to acquire a job.
The client who resides at Maglass was raped by the prophet at a secluded bush near Shabanie mine dump site adjacent to SQ houses in Zishavane.
The state claimed that on the 31st of January 2019, the complainant visited the accused for spiritual cleansing and the complainant was the last person to enter the room of the accused.
While in the room the accused is said to have prophesied that she was developing cancer in the stomach and advised the complainant that he wanted to pray for her in the bush area.
The complainant testified that, Marara gave her instructions before they went into a thicket bush.
“Marara instructed me to place some water and three stones into an empty bottle container; I walked ahead towards the bush near Shabanie dumping site area.
He told me to kneel down. He pushed me on the ground and I fell on my back. He grabbed me and pressed my body heavily with his left hand. I tried to scream for help but no one came to my rescue since it was an isolated area,” she said.
She added that, Marara removed her pants while dropping down his trousers to thigh level, placed his private organ in a condom and had sexual intercourse without her consent.
She said that, after the accused raped her, he did a shocking act.
“He put the condom into the bottle drink with water and soil. He shaked the bottle and told me to go and bath with that water and throw the bottle to the sewage”.
“I throw the bottle in the sewage and proceeded to make a report to the police. Immediately police went to his house and arrested him.”
However, Marara denied the charges stating that they were in a love relationship.
“Your worship I had consent to engage in sexual intercourse with her. I slept with her twice since we were in love for 8 days.
“She reported me to the police because she was worried of becoming pregnant since the condom burst while having sex,” he said.
Marara said the complainant initially agreed to be compensated since she was hurt and worried of the pregnancy.
She was taken for medical examination at Zvishavane Hospital and proved that she was sexually abused.
Marara’s case was remanded to the 14th of February this year for continuation of trial.
