A 73-year-old Vitalis Gaika from Gumani village headman Chipembere, Chirumanzu appeared before Provincial Magistrate Mrs Pathekile Msipa facing charges of raping a mentally challenged woman.
Gaika pleaded not guilty to rape and was remanded in custody awaiting trial next week.
It is the state case that Gaika raped the complainant sometime in April 2018 around 1600hrs while herding cattle.
Sarudzai Nyamadzavo (43) who is a mental patient from village Nyamadzavo under Headman Chipembere of Chirumanzu claimed that Gaika raped her whilst she was herding cattle.
“I was herding cattle when Gaika approached me with an axe on his shoulder, he puts his hands into my blouse, started fondling and sucking my breasts.
“He then pushed me down, undressed my pants and had sexual intercourse without my consent,” said Nyamadzavo.
Anzakaria Nyamadzavo the complainant’s mother told the court that her child’s clothes were stained.
“When I looked at her skirt, it was tainted with blood and flies,” said Nyamadzavo.
She stated that Gaika took advantage of the complainant’s illness.
“This man took advantage of my daughter’s mental condition to rape my daughter once.
Your worship this man once raped my child and the matter was resolved at the village court where I was promised a hen as the restitution,” she said.
Nyamadzavo said she gathered courage from a radio programme.
“After realising that the police were not taking action over the matter I was fortunate to come across the programme on radio about mentally challenged people.
I got interest on a radio show against sexual abuse and called the number which eventually assisted me to get the accused arrested,” explained Sarudzai’s mother.
However, Gaika denied the raping allegations.
“Your worship I want to put it to you that the complainant’s mother and Sarudzai are lying, how did I know that it was their turn to herd cattle.
“And if I raped her, why did she not report the case from April up until November,” said Gaika.
